Retail/Wholesale Partner Terms & Conditions

Please review our retail/wholesale partner terms and conditions below and electronically sign to begin ordering our products for your retail location.

1. AGREEMENT

This retail/wholesale partner agreement along with the following Terms and Conditions, shall constitute the entire agreement between Earth Born Beauty and the individual or entity identified on the Retail/Wholesale Partner information sheet. This agreement defines Earth Born Beauty’s and the Retail/Wholesale Partner’s rights and duties and contains important information. Retail/Wholesale Partner represents that he or she has read, understands and agrees to abide by this agreement.

2. ORDERS

Retail/ Wholesale Partner orders can be emailed to hello@earthbornbeauty.com or called in to 301-327-0320.

Order minimums are $200 for the initial order and $100 for all reorders.

Orders cannot and will not be held under any circumstances. Payment is required upon placement of order.

It is critical that both the Earth Born Beauty Representative and the Retail Partner be diligent about verifying the order. A Sales Order is final when it is e-mailed to hello@earthbornbeauy.com. With phone orders, the Earth Born Representative will read the order and the shipping address back to the Retail Partner. An order number will be conveyed and the sale is final. Once an order is placed it cannot be amended. 

Cancellations of orders can be done so within the first 24 hours. Orders cancelled after this time period and prior to shipping will result in an Earth Born Beauty store credit less a 15% restocking fee. Unfortunately, we cannot cancel an order if it has already been shipped.

3. PAYMENT

Orders may be paid by MasterCard, Visa, American Express and Discover.

Full payment is due when order is placed and must clear our banking institution prior to the order being released to the carrier.

Declined Payments

It is the responsibility of the Retail Partner to ensure that funds are available prior to placing an order. An Earth Born Beauty representative will call if payment is declined. The Retail Partner has up to 48 hours to call back with new credit card information. If the call is not returned; the order will be cancelled, the product will be returned to our inventory and re-stocking fees (15%) will be applied.

4. LEGAL AND DEBT COLLECTION

If at any time Earth Born Beauty needs to resort to such a process to collect overdue accounts, legal and debt collection costs will be incurred in full by the Retail Partner. This includes unwarranted charge backs.

5. SHIPPING

Due to the high level of natural and active ingredients in our products, we do not stock large volumes. There may be a 2 to 6 week lead time. Please plan accordingly.

  • Shipping options are:
  • For US Customers: United States Postal Service (USPS) Priority or United Parcel Service (UPS)
  • For International Customers: United States Postal Service (USPS) Priority. Each country has its own regulations that must be adhered to; import duty, taxes, etc. are not included in the item price or shipping cost. You will be responsible for those additional costs.
  • For phone and e-mail orders, shipping and handling charges are determined at the time of processing and will be added to the invoice. There will be a $3.50 handling fee applied to all wholesale orders.

SIGNATURE UPON DELIVERY

Carrier will require a signature upon delivery.

NON-DELIVERABLE AND REFUSED SHIPMENTS

In the case that an order is returned, due to it being refused or if no one is there to accept it, a 15% restocking fee plus applicable re-shipping costs will be applied to the Retail Partner’s account. New shipping charges will be incurred to re-send the shipment.

DAMAGED SHIPMENT

Product damaged in shipment must be reported to Earth Born Beauty within 48 hours from the delivery date. When contacting our customer service department, provide us with your company information, a description of the damage and some photos of the broken items/packaging. Be sure to keep the damaged products in the original shipping carton. Earth Born Beauty will send a replacement of the damaged products only, no substitutions or additional discounts. The Retail Partner must return damaged goods with the provided Return Authorization (RA). A tracking number and proof of shipping must be emailed to customer service within 5 business days. If terms are not completed, then the Retail Partner will be responsible for the products and no refund will be given. 

6. RETURNS

Do to the nature of our products, we cannot except any returns for any reason, other than defect.

DEFECTIVE PRODUCT

The quality of our products is of utmost importance. Although defects are rare, we need to know at once (within five days) if there is one. Call Customer Service with a brief explanation and invoice # of the product to receive a RA. Please note that expired product is not considered defective.

RETURN AUTHORIZATION (RA)

Returns need a Return Authorization (RA). Unauthorized returns will be discarded and no credits issued. Contact Customer Service to obtain a Return Authorization (RA). Return Authorization (RA) expires seven days from the issued date.

EXPIRED PRODUCT

Returns on expired items will not be accepted as they are not eligible for store credit. The Retail Partners is responsible for rotating and maintaining their stock.

The shelf life of all products is listed on the labels. Generally, all products are good for one year after the date of purchase and 8 months after opening.

EARTH BORN BEAUTY CREDIT ONLY

Refunds will be issued in the form of a credit to the Retail Partner’s account. No cash, check or credit card refunds will be issued.

CUSTOMER RETURNS

Retail/Wholesale Partner acknowledges and agrees that they are solely responsible for returns of Earth Born Beauty’s products purchased from their location by a customer.

7. PRICING

Earth Born Beauty reviews pricing at the end of every year and strives to give our Retail Partners ample notice of price changes. However, prices are subject to change without notice.

8. NO THIRD-PARTY PLATFORMS

Retail/Wholesale Partner shall not market of sell Earth Born Beauty’s products in retail outlets. Retail/Wholesale Partner shall not market or sell Earth Born Beauty’s products on sites or domains that are not owned or operated by Retail/Wholesale Partner, including Alibaba, Alibaba Express, Amazon, eBay, Groupon, Jet, LivingSocial, Rakuten, Walmart or other deal sites or third-party platforms or marketplaces.

9. REQUIRED CONDITION OF STORAGE

Due to the high level of natural and active ingredients in Earth Born Beauty’s products, they must be stored in a climate controlled environment (50-78°F), away from direct sun exposure, intense light and dampness. Containers must be tightly closed at all times when not in use to avoid damage from humidity and oxidation.
